Terms and Conditions

ChristmasDecorations.com.au provides its services to you subject to the following conditions and policies. If you register with or shop on this website, you accept these conditions. Please read them carefully.

Shipping & Delivery

We ship our products using a number of methods including Australia Post and courier. We will select the shipping method most appropriate for each customer based on the shipping location and the size and contents of the order. Because of the light, but bulky nature of our products, delivery price is usually calculated using Australia Post's standard cubic weight formula. This means that the cost of delivery is dependent directly on the size of the packages you are ordering.

All delivery costs stated are an estimate based on our shipping calculator and product database, should you feel that the shipping cost is reflected incorrectly, please contact us, we will review your case and quote you a more accurate cost if necessary.

Product will generally be dispatched within 1 to 2 days of payment being received. Personalisation will be done by our calligrapher up to 7 working days (according to the availability of the artist). Shipping times will vary according to the shipping method and destination.

Loss & Breakages

Glass Christmas ornaments are very fragile and because of this, some breakages are expected. If our products arrive broken, please contact us and we will organise a replacement for the broken goods. We will require evidence of the breakage (usually in the form of a photograph).

Returns

Should you be unhappy with the quality of the product you receive, you may return the item within 30 days and you will receive a full refund. The cost of postage is not included in this refund and any postage costs that may be incurred by you in the returning of your item will also not be covered. You are entitled to choose your own means of returning the item, but due care should be taken to ensure the item is safely and securely packaged. If it is evident that sufficient care and packaging has not been used, no refund will be issued.

Pickup

If you prefer, you can opt to have your goods be prepared for pickup by either yourself or a courier. If you choose this option, you will be sent an email when your goods are prepared along with the pick up address. All pickups require payment to be made in advance.

Privacy

We respect your privacy and appreciate your business. At no time do we ever provide your account contact or payment information to any third party vendor, associate or service provider unless neccessary in order to complete your order. We work to protect the security of your information during transmission by using Secure Socket Layer (SSL) software, which encrypts information you provide to us.

Your Account

If you use this site, you are responsible for maintaining the confidentiality of your password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. ChristmasDecorations.com.au reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

Product Descriptions

ChristmasDecorations.com.au attempts to be as accurate as possible. However we do not warrant that product descriptions or other content of this site are accurate, complete, current or error-free. Specifically, it is often difficult to replicate the exact colours of ornaments in a photograph. We do our best to ensure photographs accurately represent our products, but cannot guarantee complete accuracy due to monitor calibrations and other mitigating factors. Unless there are any exemplary factors, refunds will not be issued in such cases.

Due to the nature of our mouth blown and hand decorated christmas ornaments, sometimes there may be varying uniformities within the product range. For example, not all "balls" are perfectly round and patterns may not be identical from ornament to ornament. We consider this part of the hand-crafted beauty of the product and this is to be expected.

Applicable Law

By visiting ChristmasDecorations.com.au, you agree that the laws of the state of New South Wales and the Commonwealth of Australia, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute that might arise between you and ChristmasDecorations.com.au.

Disputes

Any dispute relating to your visit to ChristmasDecorations.com.au or to products you purchase through ChristmasDecorations.com.au shall be attempted to be solved on a personal basis between ChristmasDecorations.com.au and you the customer. However, if either party is not satisfied with the outcomes, it may be taken to a governing body such as the Department of Consumer Affairs or the Department of Fair Trading, New South Wales, Australia.

This excludes if you have in any manner violated or threatened to violate ChristmasDecorations.com.au's intellectual property rights, ChristmasDecorations.com.au may seek injunctive or other appropriate relief in any state or federal court in the state of New South Wales, Australia and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the Australian Federal Court. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
