ChristmasDecorations.com.au provides its services to you subject to
the following conditions and policies. If you register with or shop on this
website, you accept these conditions. Please read them carefully.
Shipment and Delivery
We ship our products using a number of methods including
Parcel Post and courier. When completing your order, you will be able to
choose the delivery method most suitable for you. Because of the light,
but bulky nature of our products, delivery price is usually calculated using
Australia Post's Cubic Weight formula. This means that the cost of
delivery is dependent directly on the size of the packages you are
ordering.
Loss
All items purchased from ChristmasDecorations.com.au are made
pursuant to a shipment contract. This basically means that the risk of
loss and title for items pass to you upon our delivery to the
carrier.
Breakages
Glass christmas ornaments are very fragile and because of this,
some breakages are expected. If our products arrive broken, please contact
us on (02) 9773-4681 or email us and we will organise a replacement for
the broken goods.
Pickup
If you prefer, you can opt to have your goods be prepared for pickup
by either yourself or a courier. If you choose this option, you will be
sent an email when your goods are prepared along with the pick up
address. Pickup is not available for customised products.
Privacy
We respect your privacy and appreciate your business. At no time do
we ever provide your account contact or payment information to any third
party vendor, associate or service provider unless neccessary in order to
complete your order. We work to protect the
security of your information during transmission by using Secure Socket
Layer (SSL) software, which encrypts information you provide to us.
Your Account
If you use this site, you are responsible for maintaining the
confidentiality of your password and for restricting access
to your computer, and you agree to accept responsibility for all
activities that occur under your account or password.
ChristmasDecorations.com.au reserves the right to refuse service,
terminate accounts, remove or edit content, or cancel orders in their
sole discretion.
Product Descriptions
ChristmasDecorations.com.au attempts to be as accurate as possible.
However we do not warrant that product
descriptions or other content of this site are accurate, complete,
current or error-free. If a product offered by
ChristmasDecorations.com.au itself is not as described, your sole remedy
is to return it in unused condition.
Applicable Law
By visiting ChristmasDecorations.com.au, you agree that the laws of
the state of New South Wales and the Commonwealth of Australia, without
regard to principles of conflict
of laws, will govern these Terms and Conditions and any dispute
that might arise between you and ChristmasDecorations.com.au.
Disputes
Any dispute relating to your visit to ChristmasDecorations.com.au or
to products you purchase through ChristmasDecorations.com.au shall be
attempted to be solved on a personal basis between ChristmasDecorations.com.au
and you the customer. However, if eith party is not satisfied with the
outcomes, it may be taken to a governing body such as the Department of
Consumer Affairs or the Department of Fair Trading, New South Wales, Australia.
This excludes if you have in any manner violated or threatened to violate
ChristmasDecorations.com.au's intellectual property rights,
ChristmasDecorations.com.au may seek injunctive or other appropriate relief
in any state or federal court in the state of New South Wales, Australia and
you consent to exclusive jurisdiction and venue in such courts. Arbitration
under this agreement shall be conducted under the rules then prevailing of the
Australian Federal Court. The arbitrator’s award shall be binding and may be entered
as a judgment in any court of competent jurisdiction. To the fullest extent permitted
by applicable law, no arbitration under this Agreement shall be joined to an
arbitration involving any other party subject to this Agreement, whether through
class arbitration proceedings or otherwise.
Disclaimer of Warranties and Limitation of Liability

and "as available" basis. ChristmasDecorations.com.au makes no
warranties of any kind as to the
operation of this site or the information, content, materials, or
products included on this site. You expressly agree that your use of
